On September 2022, Canada has taken the charge to introduce the implementation of 13 new regulations which are aimed to empower the workers in Canada who own foreign nationals. All 13 regulations are in power from the day of the announcement itself and have the motive to ensure the health and safety of temporary foreign workers aka TFWs in Canada.
The Minister of Immigration, Refugees, and Citizenship abbreviated as IRCC, Sean Fraser, and Minister of Employment, Workforce Development, and Disability Inclusion, Carla Qualtrough have combinedly brought up the new amendments to the Immigration and Refugee Protection Regulations and announced its effect from the same day.
The new regulations are set primarily to strengthen the safeguards of TFWs along with improving the integrity of the TFW program managed by the IRCC and International Mobility Program (IMP).
These new regulations are definitely a perk because employers exploit the work permit holders on a large scale and these regulations will not work as a shield to protect them all-wise.
Advantages of New Regulations Amended in Canada
The new regulations are no doubt introduced to multiply the well-being of the work permit holders. It does not only improve TFW protection but also aids in preventing all sorts of maltreatment and abuse while they are in Canada by:
- Compulsion on the employers to surface all the legal rights of TFW to them.
- Forbidding retaliation by employers against employees.
- Forbidding employers to charge any fees for worker recruitment and holding them responsible for the action of recruiters.
- Making the provision of health care to the employer a compulsory requirement.
- Offering private health insurance by the employers participating in the TFW program.
- Refining inspection tools and crucial training in order to strengthen their quality and timeliness.
- Magnifying awareness of the employers of their obligations in order to promote compliance with the TFW Program’s conditions.
- Multiplying the cooperation with provinces, local governments, and consulates to aid the Department in identifying issues needing immediate attention and action.
- Continuing the usage of advanced tip line services in pairs of live agents that allows workers to flag any situation of abuse or misuse of the program in a direct or indirect manner.
On a special note, ESDC also introduced an escalation mechanism to vigilant provincial stakeholders within a duration of 48 hours in any case when TFW’s health and safety are at urgent risk. This is due to the reason that it will serve to safeguard their health and safety.
Temporary Foreign Workers and their Legacy
The government is set to assure strength and dignity by maintaining the interest of employers and workers. The new amendments are built in such a way that it benefits both employers and foreign workers without disturbing their legacy.
Moreover, there are a few things that we can do on our behalf for the sake of morality to protect the interest of upcoming Canadian aspirants. On a broader note, we can present the following gestures against exploitation:
- Prohibiting the work at all costs it is exploiting in any way. There is a shortage of labor but that does not mean they will rely on traditional methods of pitching and will keep it hidden rather than mentioning it.
- Standing against wrong and giving voice to self is another way of avoiding any exploitation for not only self but also for others. Also, working more for less just to have a work permit or sponsorship should not be accepted but rather be spoken about.
- Avoid purchasing or paying for job offers or LMIA. This is the most common technique opted by the employer to exploit the laborers. They simply offer job offers or LMIA for more than $30,000-$40,000 which may magnetize you to get a PR. But paying such a high amount is the initial state of the abuse which can be multiplied if not refrained.
- Honing the skills is the key step to steer clear of exploitation instead of paying such a big amount for LMIA. This step will be an asset in the longer run.
- Moreover, learning and speaking French isn’t tough and is a matter of long duration. Instead, it is the play of just 2-3 months. This initiative will pave the route to get the PR at an easy pace along with the higher paying job with better career and growth opportunities.
